This is a question regarding information booths outside of voting locations. Can the person handing out information be from outside of the voting precinct? Can they be a minor?

🗳️ Information Booths Outside Virginia Polling Places

Short answer: Anyone — including non‑residents and minors — may hand out information as long as they remain outside the 40‑foot prohibited area. Virginia law imposes no residency requirement and no age restriction for electioneering outside that zone.

1️⃣ Can the person handing out information be from outside the voting precinct?

Yes. There is no residency requirement.

Virginia law only regulates conduct within the 40‑foot prohibited area, not who may engage in political advocacy outside it.
The statute prohibits distributing campaign materials within 40 feet of the polling place entrance, but it does not restrict who may distribute materials outside that boundary.
Virginia Law

Because the law is silent on residency, anyone — including people from outside the precinct, county, state, or even the country — may legally hand out information outside the 40‑foot zone. This is also protected political speech under the First Amendment.

2️⃣ Can the person handing out information be a minor?

Yes. Minors may legally distribute information outside the 40‑foot zone.

Virginia’s election statutes impose age requirements only for roles inside the polling place, such as Officers of Election (generally 18+, with a student‑page exception).
There is no statute restricting minors from:

  • holding signs
  • distributing literature
  • advocating for a candidate or issue
  • staffing an information booth

The only relevant legal restriction is the same 40‑foot rule.
Virginia Law

Because the law does not regulate the age of people engaging in political advocacy outside the prohibited area, minors retain full First Amendment rights to participate.

3️⃣ What is restricted?

Virginia Code § 24.2‑604 prohibits the following within 40 feet of the polling place entrance:

  • distributing campaign materials
  • attempting to influence voters
  • loitering or congregating
  • hindering or delaying voters
    Virginia Law

Outside that boundary, these restrictions do not apply.
